Agreement to these terms

Welcome to CarCoverStore. This website and its associated content, goods and services (collectively, the "website") are owned and operated by CarCoverStore. We grant you a limited license to use the website consistent with these terms, which form a legally binding contract — please read them before using the site. By using the website you agree to these terms; if you do not agree, you must stop using the website. We may modify, amend, replace, suspend or terminate these terms at any time in our sole discretion; changes take effect when posted, and your continued use of the website constitutes acceptance of the revised terms.

Eligibility

By using the website you warrant that you are eighteen (18) or over the age of majority where you live, that you are competent to agree to these terms, and that your use of the website does not violate any law applicable to you. You further warrant that no preexisting agreement prohibits you from entering into this agreement, and that if you access the website on behalf of an organization or business, you are its authorized agent with authority to bind it to these terms.

Intellectual property & limited license

CarCoverStore owns all rights in and to the website and its content, including copyrights, trademarks, patents, trade secrets and other proprietary rights. Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the website for its intended purposes.

CarCoverStore owns the CarCoverStore mark and the visual appearance, layout and look-and-feel of the website (its trade dress). You may not use our trademarks, logos, trade dress or trade names — or any colorable imitation — to indicate source, sponsorship, approval or affiliation with your goods or services. All other marks displayed on the website belong to their respective owners.

Restrictions on use

You may not use the website beyond the uses explicitly stated in these terms. You agree not to reproduce, prepare derivative works of, distribute, publicly perform or display, scrape, frame, hack, reverse engineer, crawl or aggregate the website, in whole or in part, without our prior written consent (search engines complying with our robots.txt are excepted). You are further prohibited from:

• Transmitting unsolicited commercial email through the website or to its users
• Imposing a disproportionate load on the website or interfering with its operation
• Circumventing our technological or security protections
• Using robots, spiders, scrapers or other automated technology to access the website
• Attempting to access the private data of users or third parties
• Posting content intended to collect personal information from users or third parties
• Harassing users or third parties through the website
• Posting content that threatens or encourages bodily harm or property destruction
• Posting content that infringes the intellectual property rights of others
• Posting content that constitutes fraud, phishing, pyramid schemes or chain letters

User generated content

We may allow you to post reviews, comments, photos, videos, ideas, suggestions or questions ("User Generated Content"). By submitting it, you warrant that you own full rights to it, that it is accurate and complete, that it violates no law, and that it violates no third-party rights (including intellectual property, privacy or publicity rights).

When you submit User Generated Content, you grant CarCoverStore a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute and publicly display it. We have the right — but not the obligation — to monitor, modify or delete User Generated Content at our sole discretion.

Registered accounts

To complete an order or submit content we may require you to register an account. Your account is for your use only; do not share access. You agree to provide accurate, complete and current information, and you are solely responsible for the security of your username and password and all access to your account. Notify us immediately of any unauthorized access. By creating an account you agree we may contact you by available means, including email. We may accept, reject, modify, suspend or delete any account at any time in our sole discretion.

Communication with you

By submitting your contact information, you agree that we may contact you at that information, including by email or phone. You may opt out of future marketing correspondence via the unsubscribe link in our emails or by terminating your account.

CarCoverStore as a service provider

We provide the website as a service and cannot be held responsible for the communications or conduct of its users. CarCoverStore is a computer service provider under Section 230 of the Communications Decency Act; although we may edit, remove or control displayed content, we are not an information content provider and are not liable for content created by third parties.

Third-party links & privacy

The website may link to third-party websites we do not own or control. We are not responsible for their content — review their terms and privacy policies. Our own Privacy Policy is incorporated into these terms by reference.

Pricing and product descriptions

We try to keep pricing and product descriptions as accurate as possible, but we do not warrant that they are accurate, current, complete or error-free. If a product is not as described, your sole remedy is to return it in new condition.

Prices cannot be confirmed until you submit an order; listed prices are an invitation to treat and do not bind CarCoverStore. If a product’s true price is higher than displayed, we may either contact you for instructions before shipping or cancel the order and notify you.

Shipping conditions

Products ship in accordance with our Shipping Policy, which we may modify at any time. All products are shipped free on board, freight prepaid, from the place of shipment: once we place your order with the shipping carrier, title and risk of loss transfer to you.

Post-delivery theft: CarCoverStore is not responsible for products confirmed as delivered by the carrier but alleged stolen afterward. Once delivery is confirmed to the address provided, risk of loss remains with the customer. We recommend a secure delivery location or requiring a signature on delivery.

Payment conditions

By submitting an order you authorize our payment processor to charge your card (or other approved payment method), and you agree to pay all fees on time; if you do not, you agree to pay all collection costs, including attorneys’ fees. All amounts are quoted and payable in USD; we are not responsible for foreign-transaction or similar fees charged by your bank or our processor.

You agree not to initiate chargebacks unless authorized by us in writing, and to pay any costs associated with chargebacks you initiate. If you dispute a payment, you must notify us within ten (10) days; failure to do so waives claims related to the disputed payment.

Returns and exchanges

All returns and exchanges are handled exclusively by email — write to info@carcoverstore.com (we aim to reply within 24 hours). Initiate within 30 days of delivery; during the holiday period (November 15 – January 30) the window extends to 60 days. Include your full name, order number, whether you want a return or exchange, the reason, and whether the original packaging is opened. Phone representatives cannot assist with returns or exchanges.

Returns: refunds are processed once the item (with any accessories) reaches our warehouse; you’ll receive an email confirmation, and refunds typically appear within 5–10 business days. Express/overnight shipping charges are non-refundable. We do not cover return shipping unless the return results from our error, in which case we cover it only if a replacement cannot be sent.

Exchanges: any price difference for a more expensive item is paid by the customer; if you exchange for a lesser-value item we refund the difference. One exchange request per order. Customers pay return shipping on the original item; we cover shipping of the replacement. Always obtain and keep a tracking number for your return — it’s required to recover a package lost in transit.

CarCoverStore may decline returns or exchanges that do not meet these conditions.

Warranty policy conditions

Warranty claims are handled exclusively by email — write to info@carcoverstore.com with your full name, order ID, a description of the problem and when it happened, plus clear, well-lit photos showing the issue. Phone support cannot process warranty claims.

Our warranty protects against defects in materials and craftsmanship. The original purchaser may receive replacement covers multiple times while they own the product; the warranty is non-transferable. It runs on a prorated schedule from the purchase date — keep your receipt or order ID, which is required for the warranty to apply.

• You cannot bypass the warranty process by purchasing a new cover during an active claim and requesting a refund.
• Damage from mistreatment or misuse is not covered.
• Damage from very strong winds, chemical exposure, or pests/animals is not covered.

Cover care warnings

• Never cover a wet vehicle — make sure it’s completely dry first.
• Let your vehicle cool after driving; covering a hot car can melt the cover and mark the paint. Mornings are best.
• If you’ve waxed your car, wait until it’s fully dry before covering.
• Close all windows and sun/moon roofs; raise convertible tops before covering.
• Recently painted? Consult your body shop and wait until the paint fully cures.
• Extended use may damage older vehicles, lacquer paint or pre-damaged clear coat — we’re not responsible for such damage.
• Do not cover a wrapped vehicle; it may deteriorate or discolor the wrap.
• Car covers are not designed to protect against hail.
• Our liability is limited to the product’s original purchase price.

Prorated warranty schedule

Within the first six (6) months from purchase, covers meeting our warranty conditions are replaced free. Covers damaged by Acts of God (severe winds, pests, floods, fires, storms) are not eligible for free replacement, but qualify for 70% off the original price when claimed within the first 12 months. Replacement fees are based on the original purchase price and order date:

Copyright policy (DMCA)

If you believe a user of the website has infringed your copyright, you may send us a notice complying with § 512 of the Digital Millennium Copyright Act at info@carcoverstore.com. It must include: the signature of a person authorized to act for the copyright owner; identification of the copyrighted work(s); their location on the website; your contact information; a good-faith statement that the use is unauthorized; and a statement under penalty of perjury that the notice is accurate and you are authorized to act.

If your content was removed and you believe it is not infringing, you may submit a counter-notification including: identification of the removed materials; your contact information; a statement under penalty of perjury that removal was a mistake or misidentification; consent to the jurisdiction of the applicable federal district court; a statement that you will accept service of process from the notifying party; and your signature.

Disclaimer of warranties

The website is provided on an "as-is" basis without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, quality, title, accuracy or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; if you are in such a jurisdiction, consult an attorney about your rights.

Limitation of liability

CarCoverStore will not be liable for any claims, damages, judgments, liabilities, costs, charges or fees (including attorneys’ fees), whether in tort, contract, personal injury or strict liability — including indirect, consequential, exemplary, incidental, statutory, special or punitive damages — even if advised of the possibility of such damages.

We are not responsible for content posted on the website (including reviews), or for errors, omissions, interruptions, deletions, defects, unauthorized account access or alterations. We may discontinue the website at any time without liability. Liability is limited to the product’s original purchase price. We are not liable for products confirmed delivered by the carrier and subsequently reported stolen — securing the delivery location is the customer’s responsibility.

Indemnification

You agree to hold harmless, indemnify and defend CarCoverStore and its officers, employees, agents, successors and assigns from all claims, demands, losses, damages, rights and actions of any kind arising from or related to your use of the website, your account, your User Generated Content, your violation of these terms or any law, or your violation of third-party rights. Your duty to defend does not give you control of our defense; we reserve the right to control our defense and choose our counsel.

Assignment

You may not assign or sublicense your rights and obligations under these terms. CarCoverStore may assign or sublicense its rights and obligations at any time, including in a sale of the website.

Disputes and governing law

This site is controlled and operated from Quebec, and these terms are governed by the laws of Quebec and the applicable laws of Canada, without reference to conflict-of-laws principles. You agree to submit to the jurisdiction of the courts of the Province of Quebec in connection with these terms. Those accessing the website from other locations do so on their own initiative and are responsible for compliance with local laws.

Severability, waiver & integration

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force. No term is waived and no breach consented to unless in a writing signed by the party to be charged. These terms, together with the incorporated Privacy Policy, are the entire agreement between the parties regarding the website; additional provisions in any communication from you do not bind CarCoverStore.

Limitation on actions & reservation of rights

Any cause of action arising out of or related to the website must commence within one year after it accrues; failure to assert it within one year permanently bars all relief. All rights not expressly granted are reserved to CarCoverStore.
